Q & A: “Wudu and tooth fillings…”

 

WUDU‘ AND TOOTH FULFILLING

Q. Tooth Fillings and wudu/ghusl.

A.

Firstly, it is permitted to have tooth fillings especially if there is a need. Secondly, wudu’ will be valid with fillings and they do not have to be removed as this would be in most cases extremely difficult to do.

“And Muhammad [ibn al-Hasan al-Shaybani] – may Allah Most High have mercy on him – said in al-Jami` al-Saghir: teeth should not be filled with gold although they may be with silver; meaning if [the teeth] wobble and there is a fear they will fall out so one fills it in with silver and not gold; this is also the opinion of Abu Hanifa – Allah most high have mercy on him. Muhammad – Allah most high have mercy on him – said: one may also fill his teeth with gold. The opinion of Abu Yusuf – Allah most high have mercy on him – was not mentioned in al-Jami` al-Saghir. It is said by some that his opinion accorded with Abu Hanifa – Allah most high have mercy on him. Al-Hakim mentions in al-Multaqa: if a man’s teeth begins to wobble and he fears it will fall out and he fills it with gold or silver, then there is nothing wrong with this according to Abu Hanifa and Abu Yusuf – Allah most high have mercy on them both. And al-Hasan narrates from Abu Hanifa – Allah most high have mercy on him – that he made a differentiation between teeth and the nose. Regarding teeth, he said there is nothing wrong in them being filled with gold whereas with regards to the nose, it is disliked as mentioned in al-Muhit [al-Burhani]. Abu Yusuf – Allah most high have mercy on him – said: there is nothing wrong if a person attempts to pull out his own teeth or to fill it himself. However, it is disliked if [these are done to] another’s teeth as mentioned in al-Siraj al-Wahhaj. A man reported saying: I asked Abu Hanifa – Allah most high have mercy on him – regarding this matter and he saw nothing wrong with it as mentioned in al-Dhakhira…”[1]

قَالَ مُحَمَّدٌ – رحمه الله تعالى – فِي الْجَامِعِ الصَّغِيرِ وَلَا يَشُدُّ الْأَسْنَانَ بِالذَّهَبِ وَيَشُدُّهَا بِالْفِضَّةِ يُرِيدُ بِهِ إذَا تَحَرَّكَتْ الْأَسْنَانُ وَخِيفَ سُقُوطُهَا فَأَرَادَ صَاحِبُهَا أَنْ يَشُدَّهَا يَشُدُّهَا بِالْفِضَّةِ وَلَا يَشُدُّهَا بِالذَّهَبِ وَهَذَا قَوْلُ أَبِي حَنِيفَةَ – رحمه الله تعالى – وَقَالَ مُحَمَّدٌ – رحمه الله تعالى – يَشُدُّهَا بِالذَّهَبِ أَيْضًا وَلَمْ يَذْكُرْ فِي الْجَامِعِ الصَّغِيرِ قَوْلَ أَبِي يُوسُفَ – رحمه الله تعالى – قِيلَ : هُوَ مَعَ مُحَمَّدٍ – رحمه الله تعالى – وَقِيلَ : هُوَ مَعَ أَبِي حَنِيفَةَ – رحمه الله تعالى – وَذَكَرَ الْحَاكِمُ فِي الْمُنْتَقَى لَوْ تَحَرَّكَتْ سِنُّ رَجُلٍ وَخَافَ سُقُوطُهَا فَشَدَّهَا بِالذَّهَبِ أَوْ بِالْفِضَّةِ لَمْ يَكُنْ بِهِ بَأْسٌ عِنْدَ أَبِي حَنِيفَةَ وَأَبِي يُوسُفَ – رَحِمَهُمَا اللَّهُ تَعَالَى – وَرَوَى الْحَسَنُ عَنْ أَبِي حَنِيفَةَ – رحمه الله تعالى – أَنَّهُ فَرَّقَ بَيْنَ السِّنِّ وَالْأَنْفِ فَقَالَ فِي السِّنِّ لَا بَأْسَ بِأَنْ يَشُدَّهَا بِالذَّهَبِ وَفِي الْأَنْفِ كُرِهَ ذَلِكَ كَذَا فِي الْمُحِيطِ . وَقَالَ أَبُو يُوسُفَ – رحمه الله تعالى – لَا بَأْسَ بِأَنْ يُعِيدَ سِنَّ نَفْسِهِ وَأَنْ يَشُدَّهَا وَإِنْ كَانَ سِنَّ غَيْرِهِ يُكْرَهُ ذَلِكَ كَذَا فِي السِّرَاجِ الْوَهَّاجِ . قَالَ بِشْرٌ قَالَ أَبُو يُوسُفَ – رحمه الله تعالى – فِي مَجْلِسٍ آخَرَ سَأَلْتُ أَبَا حَنِيفَةَ – رحمه الله تعالى – عَنْ ذَلِكَ فَلَمْ يَرَ بِإِعَادَتِهَا بَأْسًا كَذَا فِي الذَّخِيرَةِ

Thirdly, the position of the Hanafi School in permitting tooth fillings is actually an indication of its acceptance and validity for ritual requirements, e.g. wudu’ and ghusl and not an invalidator (nawaqid).
