Q & A: “Standing and urinating…”

STANDING AND URINATING

Q. Salam *** brother asked is it permitted to stand and urinate? Ws

A.

            In the Hanafi School, it is somewhat disliked to stand and urinate as discussed in Imam Ibn `Abidin’s Radd al-Muhtar:

“His statement: (and if he stands and urinates) due to the discouragement of doing it based on the statement of `A’isha (ra) that the Prophet (saw) only urinated in a sitting posture as narrated by Ahmad, al-Tirmidhi and al-Nasa’i and its isnad is good (jayyid). Imam al-Nawawi states in his commentary on the Sahih of Muslim: the hadiths that have been transmitted regarding the prohibition [s: of urinating while standing] are not established. However, the hadith of `A’isha is established and for that reason the scholars have said that it is disliked [s: to stand and urinate] unless one has a genuine excuse [s: such as an injury to the back, posture trouble, non-availability of a toilet, etc.]. The dislike is slight but not prohibitive…”[1]

قوله: (وأن يبول قائما) لما ورد من النهي عنه، ولقول عائشة رضي الله عنها: من حدثكم أن النبي (صلى الله عليه و سلم) كان يبول قائما فلا تصدقوه، ما كان يبول إلا قاعدا رواه أحمد والترمذي والنسائي وإسناده جيد.

قال النووي في شرح مسلم: وقد روي في النهي أحاديث لا تثبت، ولكن حديث عائشة ثابت فلذا قال العلماء: يكره إلا لعذر، وهي كراهة تنزيه لا تحريم.
